Qualcomm Counters Apple Lawsuit

San Diego-based Qualcomm has filed an "answer and counterclaim" in response to the lawsuit from Apple Computer, saying that Apple's effort "devalue the fundamental Qualcomm technologies empowering the iPhone". Apple sued Qualcomm in January, claiming that Qualcomm was charging unfair amounts for licenses to its technology. Qualcomm, for its part, said that Apple had failed "to engage in good faith negotiations for a license to Qualcomm's 3G and 4G standard essential patents on fair, reasonable and non-discriminatory terms." Qualcomm said that Apple had encouraged regulatory attacks on its businesses in various jurisdictions around the world by "misrepresenting facts and making false statements," that it had "breacha greements and mischaracterized agreements and negotiations with Qualcomm," and "misrepresented the performance disparity between iPhones using Qualcomm modems and those using competitor-supplied modems", among other points. Apple is looking for $1 billion in damages in its suit.
