| Are You Ready for the Medical Device Excise Tax? OCTANe. On March 30, 2010, President Obama signed into law the Health Care and Education Reconciliation Act enacting a new excise tax on medical device sales. The new excise tax is imposed at a rate of 2.3% on sales of medical devices after December 31, 2012.
