Broadcom Suit Against Qualcomm Dismissed

An antitrust lawsuit filed by Irvine-based Broadcom against San Diego-based Qualcomm has been dismissed by a judge in New Jersey. The lawsuit, which had been filed by Broadcom in July of last year, was dismissed in the United States District Court of the District of New Jersey. In a 47 page opinion, the court found that, among other things, Qualcomm's patents did not make it an unlawful monopolist in the 3G CDMA market, and that, the firm's alleged conduct does not support claims for monopolization or attempted monopolization. Broadcom said in a statement that it plans to continue to pursue U.S. federal antitrust claims against Qualcomm, and said that it was considering moving for reconsideration by the court, appealing the decision to the U.S. Third Circuit Court of Appeals, or filing an amended complaint. Broadcom has also filed suit in Europe against Qualcomm.
